Minutes of the Parish Council meeting held on Thursday 16th October  2008 at 7.30pm in The Nelson Room of the Village Hall.

Minutes of the previous meeting

The minutes of the meeting on 16th September 2008 were approved and signed.




Public Participation

Mr Britcher stated that as Enertrag would be appealing against the decision of SNC, SNC were the defendants. He wondered therefore why it should be necessary for anybody else, other than SNC to be represented at the Inquiry.


Mr Borrows wondered why only Hempnall, Saxlingham Nethergate and Shotesham parishes had formed the Joint Advisory Group.



Wind Farm

Mr Moulton explained the reasons the Joint Advisory Working Group (“JAWG”) had been formed. It was also stated that although Saxlingham Nethergate and Shotesham parish councils had formed the JAWG, invitations to join had since been sent out to all the local parish councils who voted against the planning application in addition to SHOWT and Mr Haslam.


Mr Hook explained that the JAWG had agreed to recommend that each of the member parish councils and SHOWT pass various resolutions (see below) to enable the JAWG to investigate further the appropriate course of action and to protect the councils’ positions to be represented at the Inquiry. Mr Hook went on to explain the significance of Rule 6 status and the financial risk associated if the parish councils’ case were to be dealt with  inappropriately .  


Mr Moulton explained that SNC would be restricted to defending their case on the grounds cited for refusal of the planning application, where as no such restriction would apply to the parish councils covered under Rule 6, hence the value of being represented in this way.


Mr Moulton also informed the public that any representations they had already made to SNC about the planning application had been passed on to the Planning Inspectorate by SNC. If anybody had any new points or they had not yet expressed their views on the application (for or against), they could still make these points in writing directly to the Planning Inspectorate before 5th November 2008. No additional information would be accepted after that date. (The clerk to publish the address of the Planning Inspectorate on the parish council website.)


Mr Hook explained that any member of the public could attend the Inquiry and if they wished to speak they could attend on an appointed day (be notified later) and may be invited to speak by the Inspector.


Various other background points were explained to the members by both Messrs Moulton and Hook.


Mr Delf proposed, Mr Pointer seconded and it was unanimously agreed that Hempnall Parish Council combine with Saxlingham Nethergate and Shotesham Parish Councils and SHOWT to form a single entity to oppose the appeal, and, subject to prior agreement on funding, for that entity to apply for Rule 6 status at the Inquiry.


Mr Hook proposed, Mr Delf seconded and it was unanimously agreed (Mr Moulton and Mrs Ashford volunteered not to vote in case it was thought that there was a conflict of interest between their parish council duties and their SHOWT membership) to contribute up to but not exceeding £2,000 towards the cost of counsel’s opinion on proposed participation at the inquiry as a Rule 6 third party.
